Terms of Service
1. Who Can Use Nestora
Nestora is available to individuals aged 16 or older. If you are under 16, you may only use Nestora with the explicit consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf.
By creating an account you confirm that you are at least 16 years old or have the required parental consent. Nestora is intended for personal, non-commercial household management. Use by businesses or organisations is not covered by these Terms.
2. Your Account
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at support@nestora.family if you suspect unauthorised access.
3. Prohibited Actions
You agree not to:
- Use Nestora for any unlawful purpose or in violation of applicable laws.
- Attempt to gain unauthorised access to other users' data or to Nestora's systems.
- Reverse-engineer, decompile, or disassemble any part of the service.
- Use automated tools (scrapers, bots) to access or extract data from Nestora.
- Upload or transmit malicious code, spam, or content that infringes third-party rights.
- Resell or commercially exploit the service without our written permission.
4. Intellectual Property
The Nestora name, logo, and software are the property of Anton Pogodin. You retain ownership of all content you create in Nestora (tasks, notes, family data). By using the service you grant us a limited licence to process and store that content solely to provide the service to you.
5. Service Availability
We aim to keep Nestora available at all times but cannot guarantee uninterrupted service. We may perform maintenance, updates, or emergency fixes that temporarily affect availability. We will endeavour to give advance notice of planned downtime.
6. Limitation of Liability
Nestora is provided “as is” without warranties of any kind. To the maximum extent permitted by Spanish and EU law, Anton Pogodin shall not be liable for indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the service — including but not limited to loss of data or business interruption.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
7. Account Termination
You may delete your account at any time from Settings → Privacy → Delete account. Upon deletion, your data enters a 30-day grace period during which you may cancel the request. After 30 days all active data is permanently deleted; backup copies are purged within a further 30 days (60 days total). Payment records are retained for 7 years as required by EU accounting law.
We may suspend or terminate your account if you materially breach these Terms, after giving you reasonable notice where legally required.
8. Changes to These Terms
We may update these Terms from time to time. If we make material changes we will notify you by email at least 14 days before the new Terms take effect. Continued use of Nestora after that date constitutes acceptance of the revised Terms. If you do not agree, you may delete your account before the changes take effect.
9. Governing Law and Disputes
These Terms are governed by Spanish law. Any disputes arising from these Terms or your use of Nestora shall be subject to the exclusive jurisdiction of the Spanish courts, without prejudice to your rights as a consumer under mandatory EU law or the law of your country of residence.
